A federal judge announced Wednesday that he is moving ahead with a contempt inquiry into the Trump administration. Specifically, U.S. District Judge James Boasberg is examining whether the Trump administration violated a court order when it used the Alien Enemies Act to deport illegal aliens to El Salvador. 

Boasberg, according to ABC News, has ordered the parties involved in the case to submit a proposal by Monday on how the case should move forward.  

The case stems back to March when the Trump administration loaded airplanes with alleged Venezuelan Tren de Aragua gang members and deported them to a maximum-security prison in El Salvador. President Donald Trump used the authority of the Alien Enemies Act of 1798 to carry out the deportation, but even before the planes landed in El Salvador, Boasberg issued a temporary restraining order and instructed the planes to return to the U.S.

The Justice Department said the administration was not obligated to obey the verbal instruction from Boasberg and the flights proceeded.  

One of the men on board the flights was Kilmar Armando Abrego Garcia, whom Democrats labeled the “Maryland Man.”  

In April, Boasberg said there was “probable cause” to hold the Trump administration in contempt for disobeying his order, but the District of Columbia U.S. Circuit Court of Appeals temporarily blocked Boasberg from moving ahead with the case. On Friday, that same court cleared the way for Boasberg to move forward with his investigation of the Trump administration’s actions.  

The investigation, according to Boasberg, may require Trump administration officials to provide formal written declaration or testify in court.  

The advancement of Boasberg’s contempt investigation into the Trump administration comes about two weeks after Rep. Brandon Gill, R-Texas, filed articles of impeachment against Boasberg over the judges alleged weaponization of power.  

“Judge Boasberg was an accomplice in the egregious Arctic Frost scandal where he equipped the Biden DOJ to spy on Republican senators,” Gill said. “His lack of integrity makes him clearly unfit for the gavel. I am proud to once again introduce articles of impeachment against Judge Boasberg to hold him accountable for his high crimes and misdemeanors.”
